REVISED ACC GUIDELINES AND PROCEDURES:  FIRST STAGE - INFORMAL PROCESS

Click here to view the revised ACC Guidelines and Procedures, which sets out an informal first stage for handling Requests for Approval (of changes to your property) as well as Complaints about violation of the Covenants.  If resolution cannot be obtained informally, homeowners may go to the second, formal stage of the process (see those documents below, on this page).  Approved by the Board of Directors, April 8, 2013.

LEGAL REVIEW:
The 6th Avenue West Homeowners Association, Inc. is the assigned "Successor" appointed by the original Architectural Control Committee (Mike Leprino and Anthony Dursey.) This issue was heard before Judge Oeffler on August 27, 2009 and the Judge resolved on September 4, 2009 that:
"The successor entity for enforcement is the new Homeowners Association Corporation ACC."

NOTICE FILING 4 AND FILING 5:

Documents have been filed in the Jefferson County Clerk and Recorders office for Filing 4 and Filing 5. We have not had these documents reviewed and cannot comment on any legal status or validity of such documents. If you are a homeowner within one of these filings and have concerns regarding any "Withdrawal Petition", you may wish to seek the advice of your own legal counsel.

You may at your own discretion apply to the Architectural Control Committee to have your lot modifications approved should you have any concern that the "Withdrawal Petitions" may be spurious or invalid.
